1. Scope

1.1 These Terms apply to all offers, reservations and contracts for the holiday apartments and other facilities let by FeWo Waitzrodt.

1.2 “Tenant” or “you” is the person entering into a rental agreement with FeWo Waitzrodt. “Guest” means the tenant and all persons registered by them. “FeWo Waitzrodt” is the landlord; the contracting party is Johannes Sommer, Waitzrodt 4, 34376 Immenhausen, Germany.

1.3 Any conflicting terms of the tenant are rejected unless FeWo Waitzrodt agrees to them in writing.

2. Reservation and conclusion of contract

2.1 FeWo Waitzrodt only accepts reservations from persons aged 18 or over.

2.2 FeWo Waitzrodt may decline individual reservations — in particular from groups — without giving reasons, or make them subject to conditions.

2.3 Submitting your booking is a binding reservation request; the apartment is held for you. You will promptly receive a reservation email with the bank details and payment deadline. Please check it and report any discrepancies without delay.

2.4 The rental contract becomes binding once your full payment has been received and you receive our booking confirmation. Please transfer the total price within 14 days of the reservation email. If payment is not received in time, the reservation is cancelled automatically and the apartment is released.

2.5 For arrivals within less than 14 days the total price is due immediately; confirmation may depend on proof of payment.

3. Changes to the contract

3.1 FeWo Waitzrodt is not obliged to accept change requests after conclusion of the contract and decides at its reasonable discretion. A reasonable change fee may apply.

3.2 The arrival date or apartment cannot be changed within 30 days of arrival; the cancellation rules under section 11 then apply.

4. Sub-letting

The apartment may only be used by the persons named in the contract. Sub-letting requires written consent. If further persons join the contract at your request, you and those persons are jointly liable for the rent and any additional costs. An administrative fee of €30.00 applies.

5. Prices and payment

5.1 The total price as shown online and in the reservation email applies. It includes the final cleaning (€60.00) and statutory VAT (7%). If you arrive without having paid in full, the outstanding amount is due on site unless you can prove timely payment.

5.2 Discounts or special offers cannot be applied retroactively after a reservation.

5.3 If full payment is not made, FeWo Waitzrodt may refuse use of the apartment. Any overpayment will be refunded.

5.4 Water and electricity are generally included. FeWo Waitzrodt reserves the right to charge for consumption significantly above average.

5.5 If payment is not made by the deadline, you are in default and FeWo Waitzrodt may rescind the contract; section 11 applies to costs.

6. Arrival and departure

6.1 You may occupy the apartment from 3:00 p.m. on the arrival day. On the departure day it must be vacated by 10:30 a.m.

6.2 No (partial) refund is due for early departure.

7. House rules

7.1 You and all guests observe the house rules, handed to you on arrival. On request, please identify yourself with a valid ID or passport.

7.2 Smoking is prohibited in the apartments and on the estate; it is only permitted outdoors in designated areas.

7.3 Each apartment may only be occupied by the number of persons stated on the website unless overoccupancy has been agreed in writing.

7.4 Necessary maintenance during your stay is to be tolerated.

7.5 Please leave the apartment swept clean (no dirty dishes, bed linen stripped, kitchen and fridge tidied, waste disposed of).

7.6 In case of serious or repeated breaches of the house rules, FeWo Waitzrodt may terminate the contract without notice. The claim to the rent remains, less saved expenses and any re-letting.

8. Pets

Depending on the apartment, up to two pets are permitted; this must be stated at reservation and is subject to a charge. Dogs must be kept on a lead throughout the estate. Pets must not endanger or disturb other guests, residents or the estate’s animals. A pet bed and effective flea protection must be brought. Visitors’ pets are not permitted.

9. Use and tenant liability

The tenant and guests are liable for damage to the apartment, its contents and the estate caused by disregarding the house rules or by their conduct, unless they prove they are not responsible. Damage must be reported immediately and compensated on site.

10. Internet use

FeWo Waitzrodt provides free Wi-Fi without guarantee of availability or speed. You use the internet at your own responsibility and comply with the law; in particular, you refrain from unlawful acts (e.g. illegal downloads). In case of suspected misuse, access may be blocked. You indemnify FeWo Waitzrodt against third-party claims arising from acts by you or your guests.

11. Cancellation, termination and emissions

11.1 If you cancel, the following fees apply (counted from the start of the stay):

• up to 60 days before: 10% of the rent
• up to 35 days before: 45% of the rent
• up to 21 days before: 60% of the rent
• up to 14 days before: 90% of the rent
• less than 14 days before: 100% of the rent

11.2 By booking you accept this scale as appropriate. FeWo Waitzrodt will try to re-let the apartment and credit any amount achieved. Travel cancellation insurance is recommended.

11.3 FeWo Waitzrodt may cancel without reason up to 60 days before the start and will then refund the full rent. After that, cancellation is possible for good cause (e.g. damage, necessary repairs, unforeseeable events on the estate).

11.4 Gut Waitzrodt is a living, working riding and country estate. Customary emissions associated with this — such as sounds and smells from animals and their care, from events or from agricultural work — are not a defect and do not justify a reduction or cancellation.

12. Liability

12.1 FeWo Waitzrodt is not liable for theft, loss or damage to property or for personal injury arising during or as a result of the stay, except as set out below.

12.2 FeWo Waitzrodt is not liable for disruptions or defects in services provided by third parties, nor for noise caused by third parties or other guests.

12.3 The above limitations do not apply to damage arising from injury to life, body or health, nor to breach of essential contractual duties, nor in cases of intent or gross negligence by FeWo Waitzrodt, its legal representatives or agents. Statutory liability otherwise remains unaffected.

13. Data protection

FeWo Waitzrodt processes your personal data solely to handle your booking and stay and to meet legal obligations. Data is shared with third parties only where necessary to perform the contract or required by law. For details and your rights, see our privacy policy.

14. Final provisions

14.1 Amendments to these Terms require text form.

14.2 Should a provision be or become invalid, the remaining provisions remain unaffected.

14.3 The law of the Federal Republic of Germany applies.
